Terms and Conditions

1. Scope and Applicability
These Terms and Conditions ("Terms") govern the sale of products by Bibinti Apparel, a brand operated by Kazarma Consulting BV ("Seller", "we", "our") via the website www.bibinti.com ("Webstore"). By placing an order on our Webstore, you ("Customer", "you") agree to be bound by these Terms. The Webstore is operated by Kazarma Consulting, a company incorporated under the laws of Belgium, and applies to all transactions for products sold worldwide.

2. Definitions

  • Contract: The legally binding agreement formed when you accept these Terms and place an order.

  • Products: Apparel items and accessories offered for sale on the Webstore.

  • Consumer: A natural person who is acting for purposes which are outside his or her trade, business, craft, or profession.

3. Formation of Contract

  • The ordering process on the Webstore constitutes an offer to purchase the Products.

  • The contract is formed upon receipt of our order confirmation email, which confirms acceptance of your order.

  • We reserve the right to cancel orders or refuse service at our discretion.

4. Prices and Payment

  • All prices are quoted in Euros (€) unless otherwise stated and include applicable Belgian and EU taxes.

  • Payment is due at the time of ordering. We accept major credit cards, bank transfers, and other payment methods as indicated on the Webstore.

  • Any additional charges, including international fees for orders outside the EU, will be clearly stated before confirmation of your order.

5. Shipping and Delivery

  • Delivery is made to the address provided during the ordering process.

  • Delivery times are estimates and may vary due to factors beyond our control.

  • Risk and title for the Products pass to you upon physical delivery.

6. Return Policy

  • Right of Withdrawal: In compliance with the EU Consumer Rights Directive, you have the right to withdraw from the contract within 14 calendar days without providing any reason. The withdrawal period will expire 14 days after the day on which you, or a third party designated by you (other than the carrier), take physical possession of the goods.

  • Procedure for Returns: To exercise your right of withdrawal, you must inform us of your decision by a clear statement (e.g., via email to sylvanm@bibinti.com). We will then confirm the cancellation and provide instructions on how to return the goods.

  • Costs of Return: Unless prohibited by applicable law, you will bear the direct cost of returning the Products. We will clearly notify you of this obligation before the conclusion of the contract.

  • Refunds: Upon receiving the returned Products (or evidence of their dispatch), we will reimburse all payments received from you, including the cost of delivery (except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), within 14 days of being informed of your decision to withdraw. Refunds will be made using the same means of payment as the initial transaction unless you have expressly agreed otherwise.

  • Exclusions: Certain goods, such as personalized items, may be exempt from the right of withdrawal. Any such exclusions will be clearly stated at the point of sale.

7. Order Cancellation and Modifications

  • You may cancel or modify your order prior to dispatch by contacting our customer service at sylvanm@bibinti.com.

  • Once the order has been dispatched, cancellation or modification may not be possible.

8. Liability and Warranty

  • We warrant that the Products conform to the description provided on the Webstore at the time of purchase.

  • Except for liability arising from personal injury or death, our liability for breach of contract or negligence is limited to direct damages, and in any event shall not exceed the total amount paid for the Products.

  • We exclude liability for any indirect or consequential damages arising from the use of our Products.

9. Intellectual Property

  • All content on the Webstore, including images, text, logos, and designs, is the intellectual property of Kazarma Consulting. BV or its licensors and is protected by applicable copyright and trademark laws.

  • No part of the Webstore may be reproduced or used without our express written permission.

10. Data Protection and Privacy

  • We process personal data in accordance with applicable EU data protection laws, including the General Data Protection Regulation (GDPR).

11. Force Majeure

  • We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay is due to circumstances beyond our reasonable control.

12. Governing Law and Jurisdiction

  • These Terms and the contract between you and us shall be governed by Belgian law.

  • Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Belgium.

13. Amendments to Terms

  • We reserve the right to update or modify these Terms at any time. The revised version will be effective as soon as it is published on the Webstore, and your continued use of the Webstore constitutes acceptance of the updated Terms.
